Terms of use
Version of October 23, 2026 · Operator: Option Web Binggeli
1. The service and its operator
Option AI is offered by Option Web Binggeli — Gregory Binggeli, Chemin du Bas-du-Crêt 40, 2013 Colombier, Switzerland; info@option-web.ch; +41 32 558 55 55.
These conditions describe the current use of the site and the studio by professionals and individuals with the capacity to contract. Consumer status depends on use and applicable law. Mandatory protections remain applicable, regardless of the chosen plan.
2. What Option AI offers
The service helps prepare marketing content, analyze sites, organize campaigns, and use external connections. The features and volumes of the plans can be found on the pricing page. The availability of a connection also depends on the authorizations and conditions of the relevant provider.
AI content and recommendations must be verified before use. We do not guarantee commercial results, search engine ranking, or citation by an AI. This does not remove legal guarantees regarding the conformity of the service.
Advertising expenses, subscriptions to external services, and advanced video generation are not included, unless explicitly agreed in writing. The use of the studio does not authorize us to commit an advertising budget on your behalf.
Visual proposals and successive audits
Each content item includes an initial visual and two new generated proposals, for a total of three successful proposals during the life of the content. Carousel thumbnails, copies, and adaptations of the same content for social networks share this counter. Modifying, deleting, or restoring an image does not reset the counter. Generations prior to the activation of this rule are not retroactively counted. The counter visible in the studio is the reference for available proposals.
Technical failures and images rejected by the automatic quality control do not consume a client proposal. An interrupted request whose outcome remains uncertain may remain reserved until verification. Automatic retries are limited. Imports, text modifications, cropping, and reuse without new generation do not consume a proposal. After exhaustion, generation is blocked for this content; other operations remain accessible. No paid pack or automatic recharge is activated.
Full audits retain their scope of public pages explorable without a page cap. During successive audits, unchanged technical checks can be reused after a validation response from the server or content comparison; modified pages are re-analyzed. The verification date and reuses are indicated. Exclusions and technical restrictions are detailed on the pricing page.
3. Accounts, access, and authorized uses
You provide accurate information, protect your access, and report any suspicious activity. In a shared space, you assign only the necessary access to authorized persons.
You must hold the necessary rights and authorizations for the content, brands, sites, images, connected accounts, and contact lists used. Audits must respect third-party rights and access restrictions. Public access to data does not authorize all its uses.
Illegal content, impersonation, infringement of third-party rights, spam, unauthorized access, and bypassing protections are prohibited. The service is not intended to store sensitive data, trade secrets, or regulated files without appropriate agreement and guarantees.
You verify the content, recipients, and rights before approval or dissemination. A schedule already transmitted to a provider may need to be canceled directly with them; disconnecting the account does not guarantee its cancellation.
4. Registration and paid contract
Public payments remain closed during preparation. The initial launch is for businesses established in Switzerland, for professional purposes, in CHF. You provide your business name and confirm your authority to bind it. Creating an account or saving a site is not an order. A subscription requires separate confirmation in Stripe and acceptance of the terms presented before payment.
Each site has its own monthly or annual subscription, paid in advance and automatically renewed at the same frequency until cancelled. The summary states the plan, allowances, total including tax, currency and frequency; an annual subscription is charged in one instalment. Paid access starts after server confirmation of payment. The billing portal provides invoices, payment-method updates and cancellation at the end of the paid period, preventing another renewal. Contact support if you have difficulty.
An upgrade requires a prorated summary and your confirmation; increased rights follow confirmed payment. A downgrade takes effect at renewal. Ordinary cancellation does not automatically refund a started period; mandatory rights, billing errors and remedies remain reserved. Unpaid charges may suspend paid actions when previously paid rights expire. The 5% additional-site discount and authorised promotions follow the summary; manual contracts are not automatically migrated. Recharges remain closed and will require a separate purchase.
5. Rights of individuals
Mandatory rights of withdrawal, conformity, repair, and refund remain reserved. For distance contracts subject to European service withdrawal rules, the period is generally fourteen days after conclusion. Information and terms specific to your contract must be provided before ordering.
The early start of a service requires the requests or agreements expressly required by law. A simple AI generation or connection to the studio does not constitute a general waiver of your rights. Exceptions applicable to digital content are not automatically transposable to a continuous service subscription.
When you have a right of withdrawal, an unambiguous statement may be sent to info@option-web.ch or the postal address above. You can use this template: "I hereby notify you of my withdrawal from the contract for [service], concluded on [date], reference [reference]. Name: [name]. Address: [address]. Date: [date]." Add your signature only for a paper submission.
The initial paid offer is not intended for private consumers. A business declaration does not remove mandatory protections if the facts make consumer rights applicable. The contacts above remain available to exercise these rights.
6. Your content and intellectual property
You retain the rights you hold over your content. You authorize its hosting, processing, and transmission to the extent necessary for the actions you request. This authorization does not constitute a general transfer of your rights.
Results generated by AI may not be exclusive or protectable; they may resemble results provided to others. You must verify their accuracy and third-party rights before exploitation.
Components, texts, brands, and software belonging to the service remain subject to the rights of their owners. Applicable third-party licenses are preserved.
7. Personal data and connected services
The Privacy Policy explains the processing, recipients, transfers, rights, and limits currently identified. Privacy information does not constitute consent to an optional purpose. The provider's AI training status is outlined there.
Before entrusting us with personal data on behalf of your organization, a suitable data processing agreement must govern instructions, security measures, sub-processors, transfers, assistance, and return or deletion. These general terms do not replace such an agreement.
Connected platforms apply their own terms. Their authorizations may expire or be revoked. Termination of an Option AI service does not automatically terminate your external contracts and does not erase content already published.
8. Availability, suspension, and liability
The service depends on external infrastructures and APIs. Maintenance, incidents, or modifications to these services may affect certain functions. No contractual availability rate is promised here.
Access restriction must be proportionate to abuse, security risk, or identified breach. We inform the concerned individual and allow them to remedy the problem when the situation permits. Mandatory remedies and refunds remain reserved.
Liability is determined according to applicable law. These terms do not exclude or limit liabilities and guarantees that cannot legally be excluded, particularly in cases of intentional or gross negligence in regimes where this is prohibited. No general "no refund" clause is applied.
9. Closing an account or requesting assistance
To request an account closure, a copy of your data, or assistance, contact info@option-web.ch. The consequences for shared spaces, content, and agreed-upon services must be distinguished. Current limits on export and backup deletion are stated in the privacy policy.
A closure request does not extinguish your rights under an already concluded contract. Legal retention obligations and the rights of other space members are examined separately.
10. Applicable law, disputes, and updates
Swiss law governs these terms, subject to mandatory protections, particularly those of the consumer's country of residence where the law provides for it. No exclusive Swiss forum is imposed in violation of your rights. Competent courts are determined according to applicable rules.
You may submit a claim to us without losing your right to recourse or having to waive any legal deadline. Information on potential mandatory mediation must be communicated for affected markets before commercialization.
Significant changes are brought to your attention under the terms required by law. The publication of a new version does not constitute automatic acceptance of an existing contract modification. The current version is dated October 23, 2026, and drafted in French; contractual information must be provided in the language required for the relevant market before subscription.
